
The High sitting in Kiambu has lifted conservatory orders that had barred the arrest or detention of governors and other affected individuals.
Justice Bahati Mwamuye vacated the interim orders after petitioners sought to amend their case, ruling that the proposed changes fundamentally altered its legal basis.
The court found that the amendments introduced new issues not contained in the original pleadings, making it untenable for the interim orders to remain in force.
The conservatory orders had previously shielded governors and certain public officials from arrest or detention pending the hearing and determination of the petition.
With the orders now lifted, law enforcement agencies are free to act without the earlier court restrictions. The case will proceed once the amended petition is formally filed and served.
