

The High Court has admitted a supplementary affidavit by former Deputy President Rigathi Gachagua alleging that President William Ruto personally called a hospital to inquire about his health during the period leading to his impeachment.
The affidavit, sworn by cardiologist Dr Daniel Kibuka Gikonyo, had been challenged by State lawyers who argued it was filed late and introduced fresh claims requiring verification.
However, a three-judge bench declined to strike it out, saying the affidavit would remain on record “in the wider interest of justice.”
In the document, Dr Gikonyo states that Gachagua was admitted to Karen Hospital on October 17, 2024, with severe chest pain and was under specialised cardiac care.
The doctor further claims that President Ruto called him while Gachagua was admitted to inquire about his condition.
State lawyers opposed the affidavit, arguing the allegations , especially the alleged phone call , were never presented during the Senate impeachment hearings and were introduced nearly one and a half years later without explanation.
But Gachagua’s legal team defended the filing, saying it provides medical confirmation that he was unwell during the impeachment process.
The case challenging the legality of Gachagua’s impeachment will be mentioned again on May 13, 2026, when Dr Gikonyo is expected to testify before the court.
