Former Migori Governor Okoth Obado has scored a major legal victory after a Nairobi court approved an agreement paving the way for the withdrawal of corruption charges against him.
In its ruling, the court said it found no evidence of abuse of power or misconduct by the Office of the Director of Public Prosecutions in reaching the agreement.
“The court has had difficulties finding that there was any abuse of power by the DPP,” the judge ruled.
The court further held that the agreement met the required legal threshold and formally adopted it, clearing the way for the withdrawal of all charges facing Obado.
“The agreement has surmounted the legal test required, and this court hereby adopts the same,” the ruling stated.
As a result, all charges against the former governor were withdrawn under Section 87(a) of the Criminal Procedure Code.
