The High Court has directed officials at Manyani Maximum Prison to escort Jackson Kihara Gachucha to recover documents linked to his late father’s estate, as he pushes to challenge his 20-year jail term.
Appearing before Justice Alexander Muteti, Jackson claimed he was wrongfully prosecuted and convicted, alleging that crucial documents tied to his case had remained concealed under instructions from his late father before his death
He told the court that with official escort, he would be able to retrieve the documents and hand them over to his family, suggesting their disclosure earlier could have altered his fate.
Justice Muteti ordered prison authorities to facilitate the exercise.
Jackson further told the court he only moved to challenge his conviction after allegedly receiving assurances of protection from the government in October 2024, maintaining that he had been framed and unfairly jailed.
He also argued that the trial court failed to consider the four years he spent in remand custody and described his 20-year sentence as excessive, noting that suspects facing more serious charges had received lighter punishments.
In addition, he cited efforts at rehabilitation, saying he trained as a teacher while in prison and submitted medical records and other documents in support of his plea for sentence review.
However, the judge noted that the High Court cannot revisit factual findings already determined by the Court of Appeal unless there are grounds for a retrial, advising him to pursue further legal options, including moving to the Supreme Court.
