Over 500 Residents of the disputed Njiru land have now been enjoined in a suit that challenges the decision of the Land’s court vesting the disputed land to the family the of late Gerishon Kirima.
The residents who are represented by lawyer Danstan Omari were enjoined in the case as interested parties with no objections from the other parties in the suit.
Justice D Mwangi directed the case to be mentioned in December 20th before the head of land division Justice Mbugua where similar other cases have been filed.
The High Court on November 22, suspended an order evicting the residents until January 29, 2023.
Justice Anne Omollo of the Environment and Land Court had directed that residents occupying the property should not be evicted until January 29 when the court will issue further orders.
The residents in their suit papers want Director of Criminal Investigations (DCI) to investigate how Kirima acquired the land in the first place.
They also want the court to compel the DCI to examine the documents presented before the court and establish who between Kirima and Italian Dominico De Masi is the rightful owner of the contested piece of land.
It is their case that the judgement evicting them from the land if executed will gravely affect them and would be negating the economic development of the area.
