National Health Insurance Fund (NHIF) CEO Elijah Wachira has been sued for contempt of court by former Naivasha MP John Mututho’s company.
Mututho’s company, Jomec Limited, wants the CEO summoned before the court to show cause why he should not be committed to civil jail for blatantly failing to comply with the consent orders issued on 6th February 2024.
Jomec in court documents claim the NHIF board has only complied with a part of the order which required both Jomec and NHIF to execute new service delivery agreements for the provision of medical health services.
According to Jomec, parties entered into negotiations early this year and agreed that the service provider waives a sum of sh 166 million and further agreed that NHIF will issue the company with a new service delivery contract for execution.
NHIF and Jomec also agreed that NHIF shall transfer an all-inclusive sum of over 188 million shillings in full and final settlement of their dispute payable in one installment.
However NHIF wrote to them on April 9 saying they will not comply with the consent order as they are unable to enter into new contracts for provision of healthcare services
“We have penned several letters addressed to the NHIF board asking it to comply with the consent orders of the court. But they have refused to issue us with the sanctioned contracts or tender a candid explanation for their blatant failure,” argued the company through lawyer Kimani Wachira.
The company further argues that it will be subjected to extreme hardships and injustice due to the respondents unlawful conduct yet the NHIF Boss played a pivotal role in the negotiations that led to the consent.
‘’It is noteworthy that in compliance with the consent orders , the applicant on its part has complied with all the necessary regulations and legal framework necessary for the insurance of the contracts, a fact that the respondents is well aware of,” claimed the company through John Mututho.
