Law Society of Kenya has come to the defense of Senior Counsel Ahmednasir Abdullahi by filing a petition challenging the Supreme Court ban against him.
The Supreme Court judges on Tuesday unanimously declared that they would not give an audience to the senior counsel accusing him of arrogantly defaming them on social media while on the other hand, wanting to have his cases heard by judicial officers he did not trust.
The lawyers’ body however, in an application filed under certificate of urgency, argues that the said decision to bar Ahmednasir together with his employees from the firm from appearing before the supreme court was unconstitutional and unreasonable.
LSK argues that Ahmednasir together with his employees were never given an opportunity to be heard and failed to consider other avenues of redress that were available.
“The supreme court judges did not consider the harm that would be caused to the lawyer, his employees and his clients…A democratic country requires pluralism ,tolerance and broadminded which respectfully ,the supreme court have failed to exercise,” argues LSK in court documents.
LSK want the court to quash the Supreme Court decision noting that the judges would have considered other avenues like how some lawyers and judges who were allegedly offended by him have sued him
LSK argues that in 1990 and early 2020’s at a time when corruption and incompetence was again said to be rife within the judiciary, it was Ahmednasir Abdullahi who almost singlehandedly took onto the task of naming and shaming the judges, resulting in the dismissal of 23 judges.
The Supreme Court judges on Tuesday failed to proceed with a matter after Ahmednasir appeared before the court to represent a family in a legal battle over a Ksh.2 billion land case with the family of the late retired President Daniel Moi.
During the virtual hearing, the judges led by Chief Justice Martha Koome said they would not proceed with the matter if Ahmednasir was part of the defense team, or if any gadget belonging to the lawyer followed the proceedings.
