Lawyer Nelson Havi now wants the court to stop the interview process of the shortlisted judges by Judicial Service Commission.
Havi argues that LSK male representative to JSC Macharia Njeru cannot participate in the consideration of applications, shortlisting and interviews since his mandate ended with the election of lawyer Omwanza Ombati.
Omwanza Ombati was elected to succeed Njeru and is scheduled to assume office on the 14 of May.
According to the lawyer, LSK will continue to suffer misrepresentation at the JSC by Njeru whose elective representative mandate ended with the election of Samson Omwanza Ombati.
The Judicial Service Commission (JSC) shortlisted 100 individuals for interviews to fill the 20 vacancies of the High Court judge.
The interviews are expected to be conducted between April 3 and April 30, 2024, this year
According to Havi, Njeru has limited powers during transition arguing that there is a conflict of interest on his part.
“It will be prejudicial and against the public interest to proceed with the interviews set to commence on 3rd April 2024 before a decision is made on serious constitutional issues raised in the petition,” he says in court documents.
