Joseph Irungu alias Jowie and Jacque Maribe will know their fate tomorrow in the murder trial of businesswoman Monica Kimani.
The two were charged in 2018 with the murder of Kimani and were found with a case to answer last year by Justice Grace Nzioka after 35 witnesses testified for the Prosecution in the murder case.
Kimani was killed in 2018 after she was discovered dead at her residence in Lamuria Gardens Apartment, situated on Kitale Lane off Denis Pritt Road in Kilimani.
Justice Nzioka who will deliver the judgment in an open court will either acquit them or convict them of the said murder.
The Prosecution led by Assistant DPP Gikui Gichuhi during the trial had claimed that that Maribe and Jowie were principal offenders, had a common intention and acted in concert to eliminate the deceased person.
Gikui told the court to consider the fact that Maribe made no attempt to disassociate herself from the actions of Jowie and instead helped him to burn evidence.
“The demeanor of Jowie and Maribe should also be taken into account at the time of investigations which entailed giving false information to the police to during the trial where the accused in some cases missed court proceedings or did not comply with bail conditions granted,” Gichuhi claimed.
DPP had claimed that the two accused persons worked in conjunction to ensure that Jowie had the transport, a menacing weapon and the opportunity to cause the death of the deceased.
But both Jowie and Maribe denied the accusations saying the prosecution failed to prove the case beyond reasonable doubt.
They claimed the case was circumstantial as there was no direct evidence linking them to the crime.
