The High Court has given three petitioners a 60-day deadline to complete their complaint against Kiambaa Constituency Development Funds Manager, Lorna Muthoni Njoroge. Justice Byram Ongaya granted the extension after parties confirmed the filing of the complaint and ongoing correspondences.
The hearing was to confirm compliance with the directive for the petitioners to file an official complaint with the NG-CDF, according to the petitioners’ lawyer. In May, Justice Ongaya directed the petitioners to lodge their complaint with the relevant offices, warning that failure to comply would result in the case being dismissed without costs.
Petitioners Richard Mulwa Musyoka, Richard Nzine, Nicholas Michael, and Elizabeth Mumbi argue that Njoroge is unfit for public office, alleging she has engaged in conduct that brings her office into disrepute due to abuse of public office and trust.
Represented by lawyer Shadrack Wambui, the petitioners claim they escalated the matter to court because no action had been taken by the relevant authorities. However, Njoroge has filed a preliminary objection, arguing the application is premature and the court lacks jurisdiction. She contends the petition is a smear campaign orchestrated by her estranged husband, as indicated in witness statements.
The case will be mentioned for compliance and further directions on November 5, 2024.
