Director of public prosecutions(DPP)  now wants to drop charges against former Broadcasting and Telecommunication PS Sammy Itemere and 12 others in the sh122 million theft case from the Government Advertising Agency.

The DPP on Tuesday asked the court for two weeks to amend the charge sheet in order to remove the thirteen accused persons.

Those let off the hook alongside Itemere include; Edith Kinda, Amos Matanga, Gladys Bwora, Gladys Isaka, Agren Jessica Ateko, Rachel Wanjiru and Nelly Nachomba.

Others include; Sammy Makau, Martin Njoroge, Hannah Wangari, Edmond Njenga and Victor Owino.

Kakamega Deputy Governor Ayub Savula and his two wives were not lucky as their case will proceed to logical conclusion.

Savula, along with former ICT PS Sammy Itemere, are accused of stealing money meant for paying pending bills to advertisers.

Last year the DPP had indicated that some of the accused in the case had written to the DPP requesting a review of the charges.

The DPP after reviewing the request, noted there was insufficient evidence to sustain the case against the thirteen.

“The new information is significant and is likely to affect the cause of this hearing and it’s on this basis that we ask this court to grant is two weeks to consult with the accused persons advocates,” the court heard.

The court will give it’s ruling to the application to withdraw charges against the 13 persons on February 8.
