It is a relief to Silica Booster Limited Innovate Manufacturers (SBL) Director, Josiah Kimani Kariuki after the high court stopped the police from arresting and detaining him over the reported fake fertiliser fiasco.
Justice Diana Kavedza issued the anticipatory bail following an application by his lawyers Danstan Omari and Cliff Ombeta who claimed his client was likely to be arrested due to a well-calculated scheme by fertilizer barons in the country.
The judge released him on sh 100,000 anticipatory bail but said the DCI and other stakeholders were at liberty to investigate or charge him for any criminal conduct.
She however directed the police to not arrest him until further orders by the court.
The defense lawyers led by Danstan Omari were directed to escort their client to the offices of the DCI for questioning and interrogation within seven days.
“Upon conclusion of investigations, the Director of Public Prosecution DPP is at liberty to present any charge against Kariuki and the Investigating Officer shall notify him to appear before court for plea taking,” ruled the judge.
According to the fertilizer Merchant, there is a scheme by fertilizer barons to edge out genuine competition by enhancing monopoly within the country.
