It is a sigh of relief to former Nairobi Governor Mike Sonko after he was freed from terrorism charges following an application by DPP to drop terrorism charges against him and two others.
Kahawa West Law Court principal magistrate Daniel Kiage on Wednesday marked the matter as withdrawn after the prosecution applied to have the 2021 case withdrawn.
“”I have considered the application by the prosecution and I hereby mark the matter as withdrawn under section 87A of the CPC,” the magistrate ruled.
Sonko had been charged alongside two others, namely Clifford Ochieng Ouko and Benjamin Onyango Odhiambo with recruiting unknown persons to commit or participate in the commission of a terrorist act in contravention of the act.
He allegedly committed the offence on or before January 1, 2021 at an unknown place within the country.
The former Nairobi Governor had also bbeen accused of being in possession of property for commission of a terrorist act, contrary to Section 6 of the Prevention of Terrorism Act, 2012.
According to the charge sheet on January 31, 2021 in Athi River, within Machakos County, Sonko had in his possession of military attire for the commission or facilitation of a terrorist act.
