The Employment and Labour Relations Court has nullified the appointment of Nicholas Kanisa, as the CEO of the Human Resource Management Professionals Examinations Board(HRMPEB).
Justice Byram Ongaya directed the Board to terminate Kanisa’s appointment saying there was conflict of interest in his appointment.
The Judge noted that Kanisa was a Board member who had taken part in critical processes leading to the creation of the vacancy of CEO before resigning.
“This was a conflict of interest thereby violating the principle of national values and public governance,” he noted.
In the case, Abdiaziz Sheikh Maad, a Human Resource professional, moved to court through lawyer Omaiyo Aranga to challenge Kanisa’s appointment saying it was illegal.
He claimed the process was marred with glaring conflict of interest and abuse of office.
“The appointment of the interested party as the CEO of Human Resource Management Professionals Examinations Board and the entire process leading to his appointment fails the constitutional test of integrity as set under chapter six,” his lawyer argued.
The court was told that Kanisa failed to disclose conflict of interest on his quest for the position he participated in creating.
